TERMS & CONDITIONS

By registering as a Member, purchasing products, or participating in the HOPE Beauty business opportunity, the applicant agrees to be bound by these Terms & Conditions, as amended from time to time.

1. Who We Are

HOPE Beauty is a beauty and lifestyle brand operating within a direct-selling model. Members are able to purchase products at wholesale price for personal use or for resale to customers at a profit. Members may also participate in the HOPE Beauty Compensation Plan, based on product sales and team-building activity.

2. Products & Services

HOPE Beauty provides beauty, cosmetics, and lifestyle products at wholesale pricing to registered Members. Products may be purchased for personal use or commercial resale. Product availability may vary and HOPE Beauty reserves the right to change product offerings, pricing, and availability without prior notice.

3. Refunds & Order Cancellations

All orders are subject to stock availability. If an item is unavailable, HOPE Beauty will refund the affected portion of the order within a reasonable period.

If a Member cancels an order, refunds may be issued subject to return condition, policy guidelines, and applicable fees.

4. Privacy & Data Use

HOPE Beauty collects and processes personal information for purposes including order fulfilment, communication, account verification, compliance, and training systems access. Personal data may be stored digitally within South Africa or internationally, depending on system infrastructure.

HOPE Beauty and Members must comply with applicable data protection laws, including POPIA and PAIA where applicable.

5. Secure Payments

Payments are processed through authorised third-party payment gateways using industry-standard encryption. HOPE Beauty does not store card information on its servers.

6. Accepted Payment Methods

  • Debit/credit cards
  • EFT / bank transfer
  • Approved payment gateways
  • Other methods added in future

Orders are processed only once payment reflects in the HOPE Beauty account.

7. Transaction Currency

All transactions are processed in South African Rand (ZAR) unless otherwise stated.

8. Legal Jurisdiction & Registered Address

These Terms are governed by the laws of the Republic of South Africa. HOPE Beauty designates its registered South African address as the domicilium citandi et executandi for all formal legal communication.

9. Amendments to Terms

HOPE Beauty may revise these Terms & Conditions at any time. Continued use of products, account access, or participation in the business reflects acceptance of updated Terms.

10. Membership Eligibility

Members must:

  • Be 18 years or older
  • Have legal capacity to enter an agreement
  • If a company applies, an authorised representative (18+) must be designated and will be responsible for compliance.

11. Member Benefits

  • Purchase products at wholesale pricing
  • Resell products for profit
  • Access member tools and systems
  • Participate in the Compensation Plan after activation

Benefits vary based on activity, not enrollment alone.

12. Earnings Disclaimer

HOPE Beauty does not guarantee income, ranks, or bonuses. Earnings depend solely on individual effort, sales performance, and consistency.

13. Voluntary Termination

Members may cancel their membership at any time via written notice to HOPE Beauty.

14. Termination by HOPE Beauty

HOPE may suspend or terminate membership if a Member:

  • Violates policies or terms
  • Misrepresents the brand
  • Commits fraud or unethical conduct
  • Damages brand reputation
  • Misuses branding or protected IP

Termination results in immediate loss of access and earnings.

15. Effects of Termination

  • All member benefits cease
  • Wholesale access is revoked
  • Earned commissions not yet processed may be forfeited
  • Backend access is removed

16. Independent Contractor Status

Members are independent business operators, not employees. HOPE Beauty does not:

  • Pay employee benefits
  • Withhold taxes
  • Control business activities

Members are responsible for their own tax and compliance obligations.

17. Branding, Marketing & IP Use

Members must follow brand guidelines and may not:

  • Create unofficial HOPE Beauty logos or packaging
  • Register brand names or trademarks
  • Present themselves as corporate representatives
  • Create misleading or unapproved advertisements

All branding remains property of HOPE Beauty.

18. Professional Conduct

Members agree to conduct business ethically, provide accurate product information, and maintain a positive customer experience.

19. Recruitment & Lineage Structure

Reassigning uplines, shifting genealogy, or manipulating placement for compensation purposes is not permitted.

Exceptions may be considered only with written approval from HOPE Beauty.

20. Commission & Bonus Payouts

Commissions are paid in the month following qualifying sales once payments clear and the sales cycle closes.

Members may receive payouts as:

  • Cash earnings
  • Credit for future orders

Calculation exclusions apply for international Members.

21. Transfer of Membership

Memberships may only be transferred if:

  • A written request is submitted
  • The new Member meets eligibility criteria
  • HOPE Beauty approves the transfer

No transfer is valid without written confirmation.

22. Data Storage Consent

By joining, Members consent to their data being securely stored and processed locally or internationally, exclusively for operational, communication, and compliance purposes.

23. Activation of Membership

A membership becomes active once:

  • Registration form is submitted
  • Minimum activation purchase is paid
  • Member receives official confirmation
